It has recently become clear that Curaçao intends to introduce so-called Pillar 2 legislation, possibly with retroactive effect to the year 2025. Although there remain considerable international uncertainty and resistance regarding the implementation of Pillar 2, Curaçao has nevertheless decided to proceed with the introduction of this legislation before it is clear how Pillar 2 will be implemented globally.

As from 1 May 2026, the Curaçao Social Insurance Bank ( ‘SVB’) will begin imposing substantial fines on employers who fail to report changes in their workforce in a timely manner. From that date onward, the SVB will actively conduct more intensive audits to ensure employers’ compliance with their obligations.
